Acceptable Use Policy

Webporter offers services which allow a wealth of public, private, commercial, and non-commercial information to be disseminated. Since such information is carried through Webporter's services, and often within a shared environment, improper use or conduct while using our services can affect other clients and Webporter's operation and business reputation.

For these reasons, Webporter has developed an Acceptable Use Policy ("AUP"), which supplements and explains certain terms of each clients' respective service agreement and is intended as a guide to your rights and obligations when utilising Webporter's services.

Clients violate Webporter's policies and the service agreement when they, their customers, affiliates, or subsidiaries engage in the following prohibited activities:

  1. Unsolicied Bulk Email/SPAM
  2. System resource abuse
  3. Intellectual property violations
  4. Adult material
  5. Defamatory or abusive language
  6. Forging of headers
  7. Illegal or unauthorized access to other computers or networks
  8. Background running programs
  9. Distribution of Internet viruses, worms, trojan horses, or other destructive activities
  10. Facilitating a violation of this AUP
  11. Usenet groups
  12. Other illegal activities
  13. Other activities

1. Unsolicited Bulk Email/SPAM

Sending unsolicited bulk and/or commercial messages over the Internet (also known as "SPAM"), can negatively impact on consumer attitudes toward Webporter, or disrupt our services to clients if Webporter's servers become blacklisted or overloaded. Furthermore, indirectly or directly maintaining an open relay which can be used by others to send spam is prohibited. When a complaint is received, Webporter has the discretion to determine from all of the evidence whether the email recipients were from an "opt-in" email list. Please refer to our Unsolicited Bulk Email (UBE) Policy for more informtion.

2. System resource abuse

Websites are prohibited from using Web applications or creating events which use excessive amounts of system resources. An excessive amount is defined as an amount which results in substantial degradation of server performance. Webporter is the sole determinant of what consititues degraded server performance.

3. Intellectual property violations

Engaging in any activity that infringes or misappropriates the intellectual property rights of others, including copyrights, trademarks, service marks, trade secrets, software piracy, and patents held by individuals, corporations, or other entities. Also, engaging in activity that violates privacy, publicity, or other personal rights of others. Webporter is required by law to remove or block access to customer content upon receipt of a proper notice of copyright infringement. It is also Webporter's policy to terminate the privileges of customers who commit repeat violations of copyright laws.

4. Adult material

Webporter does not accept "adult matieral." A common sense approach as to what "adult material" consist of should not fail, however we classify such material as follows:

  • Any site whose revenue is gained in part or whole from its adult content.
  • Photos or videos showing frontal nudity on either men or women for non-education or non-artistic purposes.

Webporter reserves the right to decide what it considers "adult content", "adult material", "sexually explicit", or "sexually related". If you are unsure whether we would classify your website as having adult material, please let us know before placing your order.

5. Defamatory or abusive language

Using Webporter's network or website as a means to transmit or post defamatory, harassing, abusive, or threatening language is prohibited.

6. Forging of headers

Forging or misrepresenting message headers, whether in whole or in part, to mask the originator of the message is prohibited.

7. Illegal or unauthorized access to other computers or networks

Illegal or unauthorised access to computers, accounts, or networks belonging to another party, or attempting to penetrate security measures of another individual's system (often known as "hacking") if prohitited, as is any activity which is used as a precursor to an attempted system penetration (i.e. port scan, stealth scan, or other information gathering activity).

8. Background running programs

Background daemons in general are prohibited on Webporter servers, including, but not limited to, IRC bots, eggdrop, BitchX, XiRCON and any other program that interferes with normal server operation. Webporter will be the sole arbitor of what consitutes a violation of this policy.

9. Distribution of Internet viruses, worms, trojan horses, or other destructive activities

Distributing information regarding the creation of and sending Internet viruses, worms, Trojan horses, pinging, flooding, mailbombing, or denial of service attacks is prohibited. Furthermore, activities that disrupt the use of, or interfere with the ability of others to effectively use the network or any connected network, system, service, or equipment is prohibited.

10. Facilitating a violation of this AUP

Advertising, transmitting, or otherwise making available any software, program, product, or service that is designed to violate this AUP, which includes the facilitation of the means to spam, initiation of pinging, flooding, mailbombing, denial of service attacks, and piracy of software is prohibited.

11. Usenet groups

Webporter reserves the right not to accept postings from newsgroups where we have actual knowledge that the content of the newsgroup violates the AUP.

12. Other illegal activities

Engaging in activities that are determined to be illegal, including advertising, transmitting, or otherwise making available ponzi schemes, pyramid schemes, fraudulently charging credit cards, and pirating software.

13. Other activities

Engaging in activities, whether lawful or unlawful, that Webporter determines to be harmful to its clients, operations, reputation, goodwill, or customer relations.

We hope this AUP is helpful in clarifying the obligations of Internet users, including Webporter and its clients, as responsible members of the Internet. Any complaints about a client's violation of this AUP can be reported to us through our contact form.
